Cedar Rapids, Iowa:  On June 26th and 27th, 2008, in a secret ballot election conducted by Region 18 of the National Labor Relations Board, employees of Clipper Turbine Works, in Cedar Rapids, Iowa, voted overwhelmingly against union representation by nearly a three to one margin.  The National Labor Relations Board has certified the results of that election, which are now final.

The election produced a dramatic voter turnout, with nearly 100% of all eligible employees participating in the election.  The tally of ballots showed that only 45 votes were cast for the Petitioner, IBEW Local 204, but that 125 NO Votes were cast against union representation.  The union challenged an additional 13 votes by employees whom the union believed were also No votes.  These ballots were not counted.  No hearing was held, post-election, to determine whether the votes should be counted as the number was not sufficient to affect the outcome of the election.

Management was represented in this process by a labor relations consulting team consisting of David Garcia, Clifton Smith and Cesar Lopez, who partnered with the management team, successfully opened a dialogue with employees and helped engineer the union’s defeat.

To prevail in these elections and defeat the union, every voter must first understand how important it is to participate in the election process.  We met that first objective with 100% voter participation.  This is an outstanding result.  Of even greater importance was the ultimate outcome of the election itself, which resulted in the resounding defeat of the union.  The consulting team’s clear, concise and comprehensive description of the process, which reviewed the union’s control over its members and which presented the limitations and risks of collective bargaining, produced an informed and decisive electorate.

These employees proved once again that knowledge is power.  After considering all of the facts, these employees decided that it was not in their best interest to unionize.  They realized that the union was not the preferred solution to the underlying issues that initially led to the union’s organizing activity.
